Untag Photos on Facebook

Why do people get offended when they post photos and the people in them untag photos on Facebook. When a person in a photo untags themselves on Facebook they normally get confronted “Why did you untag yourself from my photo?” or they do not get confronted but the person who posted the photo is wondering why the other person untagged themselves and tries to find a reason or assume a meaning for this behavior.


I cannot recall a law or statute that makes a person feel as if they have to justify themselves as to why they want to untag themselves from Facebook.


A person can argue that they never wanted their photo posted/tagged on Facebook. They may not like the way they look, they may not want to mix their personal/business lives, they may not want any memories posted, etc. They can state that they never signed a waiver nor had a contract that they were going to be tagged or posted in any pictures on Facebook


However, as a defense, the person who posted the photo can state that the person who was tagged in the photo “assumed the risk” when they posed for the camera and it took the picture. They can also state that there may be a freedom of expression to post the pictures.


To resolve this tag/untag photo issue, you can go to the picture and at the bottom of the picture it will say: (example:) In this photo: Bob Smith (photos | remove tag)


If you click on the “remove tag” function you will be untagged from the photo.


*HOWEVER, keep in mind that just because you untag yourself from a photo on Facebook does not mean that it is deleted from Facebook.


Therefore, the next time you are posing for a picture, make sure you are aware of who is taking your picture and what they could possibly do with the picture. Having a career in the legal profession is to be built on reputation. Be careful of how you and others can portray yourself on Facebook. It is very easy for someone to hit the save button on a picture and then you deal with the upsets of copyrighting, distributing, libel and other legal affairs.
