What Is Temporary Disability? What are TD Benefits?

Do you ever wonder, what is temporary disability? What are TD benefits? How does someone obtain temporary disability?  Temporary disability benefits may also be referred to as TD benefits.  Temporary disability benefits and/or TD benefits are payments that an injured worker received from the Workers Compensation insurance if the injured worker cannot perform his/her usual and customary job duties while recovering from his/her injury, disease or illness.  Temporary disability benefits are not taxable.

If an injured worker can perform partial job duties/work while recovering from his/her injury, disease or illness, but earns less than what he/she was receiving from before the injury, the injured worker will receive temporary partial disability.  Temporary partial disability may also be known as TPD benefits.

If an injured worker cannot perform any job duties nor work at all while recovering from the work related injury, then the injured worker will receive temporary total disability.  Temporary total disability may also  be referred to as TTD benefits.

Some employers have payment plans that pay an injured worker's wages for all or portions of the time that an injured worker is temporarily disabled.  These type of payment plans can be referred to as salary continuation.

There are all kinds of different salary continuation plans.  Some plans include utilizing your vacation and/or sick leave to supplement the temporary disability payments that are required by California state law.

If you are an injured worker, you may want to check with your employer to see if you are covered by one of these payment plans.  Or if you have any type of legal matter, especially pertaining to Workers Compensation or work injury matters, please feel free to contact our office.  We would be glad to be of assistance to you and inform you of your legal rights and protections.
